Terms of Use

These Terms are an agreement between you and Ensonova LLC ("Ensonova", "we", "us") for the To Dream app on iOS and Android (the "App"). By downloading or using the App you agree to them. If you do not agree, please do not use the App. Our Privacy Policy explains how your information is handled and forms part of these Terms.

1. Eligibility

You must be at least 13 years old to use the App, and old enough to agree to these Terms where you live. If you are under the age of majority, you must have permission from a parent or guardian, who agrees to these Terms on your behalf.

2. Your licence to use the App

We give you a personal, non exclusive, non transferable, revocable licence to use the App on devices you own or control, for your own non commercial use, under these Terms and the rules of the store you downloaded it from. You may not copy, modify, resell, reverse engineer or extract the App's code, audio or artwork except where the law allows it.

3. Your dreams are yours

You own your recordings, your words and everything you write in the App. You give us permission to process them only as needed to provide the features you use, as described in the Privacy Policy: for example, sending a recording for transcription after you have allowed it. We do not claim ownership of your content and do not use it to train AI models.

You are responsible for what you record. Please do not record other people without their permission where the law requires it.

4. Health and safety

Not medical advice. To Dream is a journaling, reflection and relaxation tool. It is not a medical device, and it does not diagnose, treat or prevent any condition, including sleep disorders, nightmares or mental health conditions. Nothing in the App is medical, psychological or therapeutic advice.

Sleep and hypnotic audio. Do not listen while driving, operating machinery, swimming, or doing anything that needs your full attention. Keep the volume at a comfortable level. Stop if you feel unwell or distressed.

Binaural beats. Binaural beats are optional. If you have epilepsy or a history of seizures, have a heart condition or pacemaker, or are pregnant, talk to a doctor before using them, and stop immediately if you feel dizzy, disoriented or unwell.

Lucid dreaming practice. Some people find that focusing on dreams, waking during the night, or practising reality checks affects their sleep, or brings vivid dreams, nightmares or episodes of sleep paralysis. If you have a sleep disorder, a mental health condition (including psychosis, dissociation or post traumatic stress), or take medication that affects sleep, talk to a qualified professional before starting, and stop if your sleep or wellbeing gets worse. Good sleep matters more than any practice.

If you are struggling. To Dream is not a crisis service. If you are in crisis or thinking about harming yourself, contact your local emergency services or a crisis line. In the United States you can call or text 988.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU USE THE APP'S AUDIO AND PRACTICES VOLUNTARILY AND AT YOUR OWN RISK.

5. Dream analysis and AI features

Transcriptions, titles, dream signs and dream analyses are generated by artificial intelligence provided by OpenAI and Anthropic. They can be incomplete, inaccurate or unexpected, and dream analyses are offered as perspectives to reflect on, not as facts, predictions or advice. Ancient Traditions analyses draw on historical sources that reflect the beliefs of their time. You decide what, if anything, fits your experience. AI features are only used after you allow them, and you can switch them off in Settings.

6. No account

To Dream does not require an account. The App uses an anonymous identifier to keep track of your plan and allowances. Your journal is stored on your device, so if you lose or reset your device, or delete the App, your journal may be lost unless your device backup includes it. Please back up your device if your dreams matter to you.

7. Free features, memberships and allowances

Recording, playback, your saved journal and dream analyses, every practice tool, and some nighttime audio are free with no time limit. Free also includes transcription and dream signs for your first three dreams and three dream analyses.

Two optional memberships, Lucid and Insight, are offered as auto renewing subscriptions, monthly or yearly. What each includes is shown in the App before you buy. Monthly allowances (such as transcription minutes and dream analyses) refresh on the first day of each calendar month, including on yearly plans, and unused allowance does not roll over. Silent recordings and failed attempts do not use your allowance. We may adjust allowances or features for future billing periods, and we will tell you in the App before a change affects you.

Billing and renewal. Payment is charged to your App Store or Google Play account when you confirm the purchase. Your subscription renews automatically at the end of each period at the then current price unless you turn off auto renew at least 24 hours before the period ends. You can manage or cancel your subscription in your App Store or Google Play account settings; deleting the App does not cancel it. If a free trial or introductory offer is shown, any unused portion ends when you buy a subscription.

Refunds. Purchases are processed by Apple or Google, and refunds are handled by them under their policies. We cannot issue refunds directly.

If you cancel, recording, playback and your saved work remain available on the free tier.

8. Acceptable use

Please do not misuse the App, including by attempting to get around allowances or purchases, automate requests, interfere with or overload our servers, access data that is not yours, or use the App to create unlawful, abusive or harmful content. We may limit or suspend access to the App's online features if you do.

9. Apple App Store terms

If you downloaded the App from the Apple App Store, these Terms are between you and Ensonova only, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to the extent required; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims, or for any third party claim that the App infringes intellectual property rights. Apple and its subsidiaries are third party beneficiaries of these Terms and may enforce them against you. Apple's Standard End User License Agreement also applies where these Terms are silent.

10. Google Play

If you downloaded the App from Google Play, the Google Play Terms of Service also apply to your purchase and download.

11. Intellectual property

The App, including its design, artwork, audio, affirmation scripts and software, belongs to Ensonova or its licensors and is protected by law. Historical passages used in Ancient Traditions analyses are in the public domain. Third party fonts and libraries are used under their own licences.

12. Changes to the App

We may update, change or discontinue features of the App. Features that rely on our server or on AI providers may occasionally be unavailable. If we ever end the App's online features, recording, playback and your saved work on your device will keep working.

13. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR FREE, THAT TRANSCRIPTIONS OR DREAM ANALYSES WILL BE ACCURATE, OR THAT USING THE APP WILL RESULT IN LUCID DREAMS OR ANY OTHER OUTCOME.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENSONOVA AND ITS MEMBERS, OFFICERS AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA (INCLUDING LOST RECORDINGS OR JOURNAL ENTRIES), PROFITS OR GOODWILL, OR FOR ANY PERSONAL INJURY OR HARM ARISING FROM YOUR USE OF THE APP'S AUDIO OR PRACTICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR FIFTY UNITED STATES DOLLARS (USD $50.00).

Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under the law where you live.

15. Indemnity

To the extent permitted by law, you agree to indemnify Ensonova against claims, losses and reasonable legal costs arising from your misuse of the App or your breach of these Terms.

16. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules, except where the law of your country of residence gives you mandatory protections. Disputes will be heard in the state or federal courts located in California, unless the law where you live gives you the right to bring a claim locally.

17. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may transfer them to a successor. These Terms, together with the Privacy Policy, are the entire agreement between us about the App.

18. Changes to these Terms

We may update these Terms. We will change the date above and, for significant changes, tell you in the App. Continuing to use the App after a change means you accept the updated Terms.
